The point is the law doesn’t exist independently of people enforcing it. It isn’t some natural force that will enforce itself. It only exists if people enforce it

But laws DO continue to exist even when not enforced. Just look at some of the crazy old state laws that say things like “it is illegal to eat ice cream on a Tuesday while wearing jeans”. No one enforces those, yet the laws are still clearly on the books. Trying to claim they don’t exist is just absurd.

But they’re existence is meaningless without enforcement. You’re actually proving my point. Are people going to jail for eating ice cream on Tuesday wearing jeans? Then it’s exactly the same as if the law didn’t exist. It means nothing in practice until some stupid cops and prosecutors decide to enforce it

If concede that the law is ineffective, but it most certainly exists.
You can’t choose to not enforce something that doesn’t exist.
