      Given these are both audio and visual recording it would be forced to abide by both

      Audio recording in canada is one party consent so if you are directly involved in the conversation you can record audio as for video the criminal code (R.S.C., 1985, c. C-46) seems to say that its illegal anywhere one is under reasonable expectations of privacy or if you’re doing it for your own sexual pleasure

      Yes, he consented already IF he is in a public place ie the street or enter a store front.
