Today, the Internet Archive has submitted its appeal [PDF] in Hachette v. Internet Archive. As we stated when the decision was handed down in March, we believe the lower court made errors in facts and law, so we are fighting on in the face of great challenges. We know this won’t be easy, but it’s a necessary fight if we want library collections to survive in the digital age.
Oh man, I love the IA and I hope they do well (and I donate to them yearly) but this seems like an awful waste of resources.
In this case they are NOT operating as a Library. They do not own a fixed number of copies of these things and loaning them out. They are making new copies of their own.

Honestly, they should have settled. I’m not sure how much the publisher’s settlement was, but I bet they’re going to lose this appeal anyway :/
