You could argue that the settlements are illegal, on the other hand niter side acknowledged the existence of the other side, so besides what the clownshow UN makes up there is no actual grounds about this.
The “warcrimes” have to be investigated individually and prosecuted, but warcrimes happen in every war, there is a big difference between systematic and individual committings, for example, Ukraine did technically commit warcrimes by fighting the Russian invasion from inside cities and living areas, however this was not intentional to use human shields and very much to defend the citizens from a active invasion targeting civilians above all military targets, on the other hand, Russia quite literally works towards a genocide, just like hamas does when not hiding in tunnels under partially protected grounds.
