So a criminal conviction can be hinged on a vague suspicion of the identity of a third party? What if it comes out that it was actually the muffin man?

If someone takes bribes and hands over information on camera you don’t need to know exactly who was receiving it, the crimes are the bribery and espionage.
It might have been corporate intrigue, it might have been high treason, but you can prove the espionage.
