Melania Trump’s application for U.S. citizenship has often been questioned as she gained it through the EB-1A visa program. This category is officially reserved for people of ‘extraordinary ability’ who have attained the very highest level of science, arts, or business. However, examining Melania’s application in 2001 raises serious questions about whether she met those standards at all. She was a working model, not a Nobel Prize winner or world-renowned researcher, and there is little public evidence of achievements on that level. Her portfolio reportedly consisted mainly of advertisements and a small number of magazine covers, which appear far from the extraordinary accomplishments the EB-1A category is meant to recognise.

Despite Melania’s seemingly easy access to a high level status, Somali-American Congresswoman Ilhan Omar has faced a constant barrage of criticism. Although Melania’s ‘extraordinary’ status has never been clear, Ilhan’s legitimate refugee status has been used against her by political opponents who have constantly demanded investigations from the DOJ. Despite there being no evidence of any wrongdoing, Ilhan is constantly under intense forensic scrutiny. Whereas Melania who supposedly worked in the U.S. for a short period of time and then got a legal work visa has avoided this completely.

It is worrying to see how different the immigration story in America is. The ‘merit-based’ system promoted by the Trump administration seems to be based on wealth, race and your connections rather than actual genius. If a white woman from Europe can use a high level loophole to become a citizen it is seen as a win. However if a black Muslim refugee becomes a citizen via the correct route and gains political power she is a reason for the DOJ to get involved.

If we are going to have a real discussion around immigration we need to stop using the term ‘Einstein’. Why was the process so easy for someone with a questionable ‘extraordinary’ status? Why do they treat refugees so harshly when they have done just as much to help America?
